Terms of Service

The terms that govern your use of the Bitsby non-custodial crypto payment gateway.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Bitsby service, available at bitsby.app and dash.bitsby.app ("Service"). By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Service Description

Bitsby is a non-custodial crypto payment gateway. The Service provides invoicing, payment detection and notification tooling that lets merchants accept cryptocurrency payments directly to their own wallets. Bitsby never holds, stores, transmits or has access to your funds or private keys at any point. All payments occur on public blockchain networks directly between the payer and the wallet addresses you provide.

3. Accounts

You must provide accurate information when registering and keep your credentials secure. You are responsible for all activity under your account. The Service does not require identity verification (KYC); however, you remain solely responsible for complying with the laws applicable to you and your business.

4. Fees

The Service charges a fee of 0.5–1% per successful transaction, payable in cryptocurrency and deducted from your Service balance. The applicable rate for each project is reviewed periodically and shown in your dashboard. Fee payment may be deferred for up to one week. New accounts receive a one-time $5 balance bonus. Fees do not include blockchain network (miner/gas) fees, which are paid by the parties to the transaction.

5. Your Wallets and Responsibility for Funds

You provide the wallet addresses to which payments are made. You are solely responsible for the accuracy of those addresses, the security of the corresponding wallets and private keys, and any loss resulting from compromised keys, mistyped addresses or third-party wallet failures. Transactions on blockchain networks are irreversible; Bitsby cannot cancel, reverse or recover them.

6. Acceptable Use

You may not use the Service to accept payments for activities that are illegal in your jurisdiction or that of your customers, including but not limited to: sale of prohibited goods or substances, fraud or phishing, money laundering, terrorist financing, transactions involving sanctioned persons or territories, malware distribution, or infringement of intellectual property rights. We may suspend or terminate accounts reasonably suspected of such activity.

7. Affiliate Program

Partners may earn a share of Service fees generated by referred users, as described on the Service website. Referral attribution is permanent. Affiliate rewards are paid in cryptocurrency to the partner's balance. Self-referrals, misleading promotion and spam are prohibited and may result in forfeiture of rewards and termination of the partner account.

8. Third-Party Services and Networks

The Service depends on public blockchain networks, wallet software and other third-party systems that Bitsby does not control. We are not responsible for their availability, performance, forks, congestion, or fees, nor for exchange-rate fluctuations of any cryptocurrency.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, timely or error-free. Cryptocurrency involves significant risk; you use the Service at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, Bitsby and its operators shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or digital assets. In any case, our aggregate liability arising out of the Service shall not exceed the total fees you paid to the Service during the three (3) months preceding the claim.

11. Suspension and Termination

You may stop using the Service at any time. We may suspend or terminate access to the Service for breach of these Terms. As the Service is non-custodial, termination never affects funds in your wallets — they always remain under your control.

12. Changes to These Terms

We may update these Terms from time to time. The current version is always available on this page with the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Republic of Kazakhstan. Any disputes arising out of or in connection with these Terms shall be resolved in the courts of the Republic of Kazakhstan, unless mandatory law provides otherwise.
